حماية الصالح العام في ضوء أحكام الملكية الفكرية دراسة تحليلية تطبيقية على حقوق المؤلف

يعد إقرار حقوق المؤلف وحمايتها نتيجة لسيادة القانون في أي مجتمع، إلا أن هذه الحقوق يجب ألا تأتي على حساب الصالح العام للمجتمع والمتمثل في حقه في المعرفة وحرية تداول المعلومات وحماية تراثه، لذلك وجب أن يكون هناك توازن محقق بين كل من حقوق المؤلف وحماية الصالح العام لهذا المجتمع. ومن ثم هَدَفَت هذه الورقة البحثية إلى إلقاء الضوء على مدي مراعاة القواعد المنظمة لحقوق المؤلف للصالح العام للمجتمع والتعرف على الآليات التي تم إقرارها لحماية هذا الصالح، وذلك من واقع الاتفاقيات الدولية بالإضافة إلى قانون حماية حقوق الملكية الفكرية المصري. وباستخدام المنهجية الوصفية والتحليلية المقارنة تم استخلاص الآليات التي تم إتباعها، في إطار حقوق المؤلف علي المستويين الدولي والوطني، بغرض الحفاظ علي الصالح العام للمجتمع. حيث تفيد نتائج البحث في إبراز آليات حماية الصالح العام للمجتمع في مواجهة القيود التي تفرضها قواعد حماية حقوق المؤلف.
The recognition and protection of author's rights is the result of the rule of law in any society, but these rights must not come at the expense of the public interest of the society, which is its right to knowledge, freedom of information and protection of its heritage, so there must be a balance between both author's rights and the protection of the public interest of the society. The aim of this research paper is to shed light on the extent to which the rules regulating the rights of the author are in the public interest of the society and to identify the mechanisms that have been adopted to protect this interest, from international conventions as well as from the Egyptian Intellectual property Rights Protection Act. Using the comparative descriptive and analytical methodology, the mechanisms that have been followed, within the framework of the copyright at the international and national levels, for the purpose of preserving the public interest of the society. The results of the research are instrumental in highlighting the protection mechanisms for the protection of the public interest of the community in the constraints imposed by the protection of author's rights rules.
