دور القانون الدولي في ضبط استخدام التكنولوجيا في الفضاء الخارجي

المستخلص

تظهر أهمية هذا البحث في وجود استخدامات كثيرة للتكنولوجيا في الفضاء الخارجي، وتحتاج هذه الاستخدامات إلى ضبط، ومن الاستخدامات السلمية: استخدام تكنولوجيا الفضاء في تنفيذ خطة 2030م، وذلك من خلال عدة أمور، منها: استخدام تكنولوجيا الفضاء لأغراض التنمية الاجتماعية والاقتصادية في سياق مؤتمر الأمم المتحدة للتنمية المستدامة، وخطة التنمية لما بعد عام ٢٠١٥م، وفي الاستشعار عن بعد، وفي التخفيف من الحطام الفضائي، دعم إدارة الكوارث بواسطة النُّظم الفضائية. كما أن لها استخدامات مدنية كثيرة كاستخدام تكنولوجيا الفضاء في الإغاثة، وفي الرؤية لفاقدي البصر. وهناك –أيضا- استخدامات تجارية كثيرة لتكنولوجيا الفضاء الخارجي الآن، منها: استخدام تكنولوجيا الفضاء في الاتصالات الفضائية، والسياحة الفضائية، والنقل الفضائي. أما الاستخدامات غير السلمية –العسكرية-، فمنها: استخدام تكنولوجيا الفضاء في الهجمات السيبرانية، والتجسس الرقمي، وتوجيه الأسلحة عن بعد (القنابل الذكية). وكان من نتائج هذا البحث إثبات أن هناك دورًا للقانون الدولي في ضبط الاستخدام الدولي لتكنولوجيا الفضاء الخارج، وذلك من خلال معاهدات الأمم المتحدة الخمس المتعلقة باستخدام الفضاء، كما أن للجنة استخدام الفضاء الخارجي في الأغراض السلمية، ومكتب الأمم المتحدة لشؤون الفضاء، دورًا في ضبط الاستخدام السلمي لتكنولوجيا الفضاء. كما أن للقانون الدولي الإنساني دورًا في مواجهة الاستخدام العسكري لتكنولوجيا الفضاء الخارجي، وتم التوصل إلى انطباق قواعد القانون الدولي الإنساني ومبادئه على الاستخدام العسكري لتكنولوجيا الفضاء، وليس معنى ذلك أن القانون الدولي الإنساني يضفى الشرعية على الاستخدامات العسكرية لتكنولوجيا الفضاء، مثل: الهجمات السيبرانية، والتجسس الرقمي، وغيرهما .
The importance of such research is reflected in the existence of many uses of technology in outer space, which need to be controlled, and from peaceful uses: the use of space technology in the implementation of the 2030 Agenda, through, inter alia: the use of space technology for social and economic development in the context of the United Nations Conference on Sustainable Development, the post-2015 development agenda, remote sensing, space debris mitigation, space system-based disaster management support. It also has many civilian uses, such as the use of space technology in relief and in vision for the blind. There are also many commercial uses of outer space technology now, including: space technology for space communications, space tourism and space transport. Non-peaceful uses, including cyber-military technology, cyber-smart-weapon technology, and cyber-bomb guidance. One of the results of that research was to demonstrate that international law had a role in controlling the international use of outer space technology through the five United Nations treaties on the use of space, and that the Committee on the Peaceful Uses of Outer Space and the United Nations Office for Space Affairs had a role in controlling the peaceful use of space technology. International humanitarian law also has a role to play in countering the military use of outer space technology, and the applicability of the rules and principles of international humanitarian law to the military use of space technology has been found, which does not mean that international humanitarian law legitimizes the military uses of space technology, such as cyber attacks, digital espionage and others.
