المستخلص

يهدف البحث إلى تناول نازلة معاصرة، وهي: أنظمة الذكاء الاصطناعي واستخداماتها في المجال الطبي، والأحكام الفقهية المتعلقة بها، وفيه مقدمة، وتمهيد، ومبحثان، وخاتمة، المبحث الأول: يتناول ماهية الذكاء الاصطناعي، ونشأته، وأهميته، ومخاطره، وصور استخدامه في المجال الطبي، والمبحث الثاني: الأحكام الفقهية لاستخدام الذكاء الاصطناعي في المجال الطبي، والخاتمة التي توصلت فيها إلى جملة من النتائج، منها: أن الذكاء الاصطناعي فرع من علوم الحاسب، يمكن بواسطته خلق وتصميم برامج للحاسبات التي تُحاكي أسلوب الذكاء الإنساني؛ لكي يتمكن الحاسب من أداء بعض المهام بدلاً من الإنسان، وتتمثل أهمية أنظمة الذكاء الاصطناعي في المجال الطبي في: تقديم الرعاية الطبية من خلال تحليل الأمراض وتشخيصها، واستخدامها في تطبيقات الجراحات الإشعاعية، ومجال التعديل الجيني، وغير ذلك، وأن لها العديد من المخاطر أيضًا، وأنه لا مانع من إجراء التجارب الطبية بواسطة الذكاء الاصطناعي على الحيوانات بضوابط معينة، وأما إجراء التجارب العلمية والطبية على البشر عن طريق تقنيات الذكاء الاصطناعي فإن أدى إلى إلحاق الأذى بالإنسان فحكمه الحرمة، وإن كانت تلك التجارب لا تضر بالإنسان أو كان ضررها قليل يُتحمل فحكمها الجواز، بشرط تحقق الضوابط الشرعية والقانونية المقررة لها، وأنه لا مانع من إجراء العمليات الجراحية عن طريق استخدام الروبوت الجراحي، وأنه لا مانع من طباعة الأعضاء البشرية بتقنية الطباعة ثلاثية الأبعاد، وأن من الأسباب الرئيسة لاستخدام الشرائح الذكية وزراعتها في جسم الإنسان تشخيص وعلاج بعض الأمراض المستعصية، وهذه لا مانع منها شرعًا، أما زرع الشرائح الذكية(الرقائق الذكية) في جسم الإنسان لأغراض تحسينية فلا يجوز، وأن الشركة المُصنعة أو المنتجة لأنظمة الذكاء الاصطناعي مسؤولة عن عيوب التصنيع التي تؤدي إلى خروج هذه الأنظمة عن الإطار الطبيعي للاستخدام، وأنه لا مانع من تضمين مُلاك ومستعملي أنظمة الذكاء الاصطناعي في المجال الطبي.. وقد أوصيت بعدة توصيات، منها: ضرورة قيام الدوائر الصحية على مشاريع وأبحاث الذكاء الاصطناعي، وتطويعها للعمل لصالح الناس عامة والمرضى بصفة خاصة، أوصيت الدوائر القانونية بضرورة الالتفاف حول قانون دولي تتبناه الهيئات والمؤسسات العالمية كالأمم المتحدة، يقوم على تنظيم جميع الجوانب القانونية لأنظمة الذكاء الاصطناعي الحالية، ووضع تصور لما يمكن أن تصل إليه في المستقبل، كما أوصيت بضرورة تشديد الرقابة على شركات تصنيع وتطوير أنظمة الذكاء الصناعي بصفة عامة، وما يختص بالمجال الطبي بصفة خاصة.
 
Abstract :
The research aims to address a contemporary catastrophe, namely: artificial intelligence systems and their uses in the medical field, and the jurisprudential rulings related to them, and it has an introduction, an introduction, two sections, and a conclusion, the first topic: deals with the nature of artificial intelligence, its origin, importance, risks, and images of its use in the medical field, and the second topic: jurisprudential rulings for the use of artificial intelligence in the medical field, and the conclusion in which it reached a number of results, including: Artificial intelligence is a branch of computer science, through which it is possible to create and design computer programs that simulate the method of human intelligence, so that the computer can perform some tasks instead of humans, and the importance of artificial intelligence systems in the medical field is: Providing medical care through disease analysis and diagnosis, and using them in the applications of radiosurgery, the field of genetic modification, etc., And that it has many risks as well, and that there is no objection to conducting medical experiments by artificial intelligence on animals with certain controls, and as for conducting scientific and medical experiments on humans through artificial intelligence techniques, if it leads to harm to humans, it is ruled inviolable, and if these experiments do not harm humans or if their harm is little, then their ruling is permissible, provided that the legal and legal controls prescribed for them are met, and that there is no objection to performing surgeries through the use of a surgical robot, and that it does not It is forbidden to print human organs with three-dimensional printing technology, and that one of the main reasons for using smart chips and implanting them in the human body is the diagnosis and treatment of some incurable diseases, and these are not prohibited by Sharia, but implanting smart chips (smart chips) in the human body for improvement purposes is not permissible, and that the manufacturer or producer of artificial intelligence systems is responsible for manufacturing defects that lead to the departure of these systems from the natural framework of use, and that there is no objection to including owners and users of artificial intelligence systems In the medical field. I recommended several recommendations, including: the need for health departments to carry out artificial intelligence projects and research, and adapt them to work for the benefit of people in general and patients in particular, I recommended the need for legal departments to circumvent an international law adopted by global bodies and institutions such as the United Nations, based on regulating all legal aspects of current artificial intelligence systems, and developing a vision of what they can reach in the future, and I also recommended the need to tighten control over companies manufacturing and developing artificial intelligence systems in general, and what concerns the medical field in particular.
