المستخلص

يعد الحق في الصورة من الحقوق اللصيقة بالشخصـية التى تثبت للإنسان منذ ميلاده وهو حق غير قابل للتصرف فيه ولا يتقادم، وللورثة حق في الاعتراض على نشـر صورة مورثهم.
ويتقيد حق الورثة بما كان يتقيد به حق المتوفى بنفسه، فإذا كان من الشخصـيات العامة أو المشهورة فيجوز نشـر صورته بعد وفاته دون التوقف على إذن الورثة بشرط ألا تمس الصورة حياته الخاصة.
وتعددت صور الاعتداء على الصورة بتطور الأجهزة مثل الهواتف المحمولة والمواقع الإلكترونية، فإن نشـر صورة شخص دون رضاه يعد عملا غير مشـروع لأنه يمثل اعتداءً على الحق في الصورة بغض النظر عن ثبوت وقوع ضـرر لحق بصاحبها أو ارتكاب خطأ وتوافر سوء النية من المصور والقائم بنشـرها.
فمشـروعية التقاط صورة لشخص تتمثل في وجوب الإذن وموافقة صاحبها ويكون الرضا صريحا بالموافقة الكتابية أو الشفهية ووجوب وجود ترخيص صريح ومحدد لطريقة النشـر، يصدر ممن يملك إصداره وتحديد نطاق استعمالها والسماح بأى تعديل أو تغيير فيها .
وهناك حق في الإعلام كقيد على الحق في الصورة عند وجود تعارض بين مصلحة الشخص ومصلحة الجمهور فى العلم بوصفها مصلحة مشـروعة مثل رغبة جمهور الناخبين في التعرف على صورة المرشح .
وتتعدد طرق الحصول غير المشـروع على الصورة والتى تتمثل في التقاطها وتسجيلها ونقلها وتصديرها ونقلها عبر الإنترنت والأقمار الصناعية والمونتاج واستخدام الصورة في غير الغرض الذى التقطت من أجله.
وتتم الحماية المدنية للحق في الصورة بالرقابة الذاتية والتصحيح لما نشـر فى غضون 3 أيام من استلام التصحيح .
ويتم الإعفاء من المسئولية المدنية الناتجة عن التصوير دون إذن لوجود صفة العمومية وإباحة التصوير لأسباب ثقافية أو تعليمية أو للنقد الساخر وتصوير شخصية عامة أو تاريخية أو مشهورة وتصوير الأحداث العامة وحق إعلام الجمهور ويستخدم التعويض عن الاعتداء على الحق في الصورة حتى ولو لم يكن هناك سوء نية على الرغم من عدم تطلب إثبات الضـرر للحصول على التعويض .
 
Abstract:
The right to a photo is considered one of the rights that are attached to the personality and are ascribed to a person from his birth .
It is an inalienable right that is subject to no statue of limitations.
The heirs have the right to object to the publication of the photo of their deceased. The right of the heirs is restricted by what the right of the deceased himself was restricted to .If he was a public or famous figure, it is permissible to publish his photo after his death without Trelying on the permission of the heirs, on the condition of seeking permission from the heirs. The picture is his private life.
There have been many forms of assault on the right to the image with the development of devices such as mobile phones and websites .
Photographing a person without his consent is considered an illegal act because it constitutes an assault on his right to the photo , regardless of whether it is proven that harm has been caused to him, a mistake has been committed , or there is bad faith on the part of the photographer and the person publishing .
The legitimacy of this is represented by the explicit consent of the owner of the image , whether written or verbal, specifying the method of the publishing it , the scope of its use , and allowing any modification or change .
There is a right to information as a restriction on the right to the image when there is a conflict between the interest of the person and the interest of the public in knowledge as a legitimate interest , such as the desire of the electorate to know the image of the candidate .
There are many ways of illegal access , which include taking the image , recording it , transmitting it via the internet , satellites , montage , and using the image for which it was taken.
Civil protection of the right to the image is achieved through self censorship and correction of what is published with in three days of receiving the correction.
Civil liability resulting from photo graphy for cultural or educational reasons or for satirical criticism is exempted.
And photographing a public figure ,history , or a famous person , photographing public events and the right to inform the public
Compensation is due for infringement of the right to the image , even if there is no bad faith and even though proof of harm is not required to obtain compensation .
